We regularly represent real estate investors, developers, brokers/agents, and owners in the following types of matters; business formation and choice of entity, contract drafting, partnership issues, CC&R drafting, condominium declarations, zone changes, HOA issues, construction defect litigation, 1031 Exchanges, tax planning, leases and evictions.
We also regularly represent borrowers and lenders in foreclosure proceedings and trustee sales including deficiency judgment actions. We routinely advise clients on the tax and legal ramifications of short sales.
We currently serve as counsel for a large insurance company on construction defect litigation matters in Southern Utah.
Our Government Affairs attorneys represent the Utah Association of Realtors as well as numerous other real estate groups and companies on matters before the Utah State Legislature
Development & Zoning
We have completed declarations of condominiums, subdivisions, have established HOA’s, and have obtained zone changes and conditional use permits for purposes of real estate developments for our clients.
We work with City Councils, Planning and Zoning Commissions, and their staff in obtaining the proper approvals and compliance with the local laws and ordinances that are crucial to the successful real estate development project.
Contracts & Transactions
We regularly draft, review, and negotiate real estate sales contracts, leases, notes, deeds of trust, and mortgages.
We counsel clients on favorable tax treatment for the structure of their transactions and have completed numerous 1031 exchanges, retirement plan real estate investments, and step-up basis setting structures.
