Kevin is an associate attorney at the Phoenix, Arizona office of Kyler Kohler Ostermiller, and Sorensen, LLP (“KKOS Lawyers”). Kevin’s practice areas include real estate, self directed IRA law, business entity formation, and estate planning. Kevin is a zealous advocate for his clients and has a passion for finding solutions to their problems and his experience in the law is broad. His experience prior to joining KKOS lawyers allowed him to focus on representing the small business owner in many facets of the law, including business transactions and litigation, real estate matters, probate, bankruptcy, and estate planning.
In his current practice, he has setup hundreds of companies across the country for clients in order to maximize tax strategies and asset protection, including IRA LLC’s, Series LLC’s, and s-corporations. He regularly advises clients on self-directed IRA matters including prohibited transactions, UBIT, and UDFI tax. He also focuses his practice in setting up Solo 401k’s for clients and implementing that into the client’s overall business planning structure. He has set up hundreds of simple and complex estate plans for business owners and non-business owners and regularly advises on trust funding, trust administration, and probate avoidance. He regularly advises commercial and residential landlords and commercial tenants and has drafted, reviewed, and negotiated dozens of commercial rental agreements. He regularly advises both sellers and buyers of real estate and has reviewed, drafted, and negotiated dozens of purchase transactions of real estate, including subject to deals and seller carry back financing on both raw land and income producing properties. He regularly advises private lender clients and commercial borrowers and has drafted and reviewed dozens of commercial loan agreements and has advised lenders on the process of enforcing a loan agreement against a defaulting borrower including through the foreclosure process. He has also successfully negotiated settlement of many disputes among parties to an agreement, including business partner disputes, contractor-subcontractor disputes, landlord-tenant disputes, borrower-lender disputes, and buyer-seller disputes. He has drafted agreements and negotiated the terms of hundreds of business transactions including purchase and sales agreements, partnership agreements and partnership tax matters, buy-sell agreements, franchise agreements, and restrictive covenant agreements.
Kevin is a member of the Arizona State Bar and licensed to practice law in the United States District Court of Arizona, the United States Bankruptcy Court – District of Arizona, and all Arizona State Courts. Kevin obtained his undergraduate degree from the W.P. Carey School of Business at Arizona State University, and his J.D. from the Sandra Day O’Connor College of Law at Arizona State University. Kevin lives in the East Valley of Phoenix, AZ with his wife and two kids. Outside of work, he loves spending time with his family and playing as much golf as his schedule allows.
